ONLY ONE LIGHT

LORRY DRIVER FINED

A charge of failing to have the two headlights of his motor-lorry burning was made against James SHeridan in the Lower Hutt Court today, before Mr. E. Page, S.M. The charge referred to the day on which Sheridan's motorlorry struck a bicycle ridden by Mr. W. T. Cotton, who died as tho result.

Mr. D. M. Dickson appeared for Sheridan and Sergeant J. W. McHolm conducted the case for the police.

Edward Munro Heathcote said that at 5.30 a.m. on April 28 he was on his milk round when the defendant's lorry passed him with only ono light burning. Corroborative evidence was given by Kevin Clarence. Howard,- who was assisting on' the milk round.

Constable Gordon said-that on examining tho lights on the defendant's lorry after tho accident ho found that only one was burning. Tho globo of the other light was broken, and there was no reflector.; The defence was that both lights were burning on the day before .the- accident, but tho glass of ono of the lights was broken about a week prior to the accident. -

Shoridah said that when lio switched on the lights in tho yard before setting out on the morning of the accident ho saw the reflection of the lights on the wall, but he was not certain that both lights were burning as he proceeded afterwards along the Hutt Eoad, whore the accident occurred.

The Magistrate imposed a fine of £.!..■ .

Counsel said that civil proceedings wevo ponding.

Sergeant McHolni said there would bo no further criminal proceedings.
