DAMAGES AWARDED

SEQUEL TO A COLLISION

Special and general damages totalling '£903 5» were claimed in the Supreme Court yesterday afternoon by Harold Organ, ironinoulder,. of Wellington, from Angelina Elizabeth Harrison, dairy farmer, of'South Maka'ra, in respect'of injuries received by him, in a motor collision at the intersection o£ Boulcott and Willis Streets on March 30 this year. The case came before Mr.'Justice Blair and a jury. Liability for the accident was admitted by/the defence, the only question -involved being the assessment of damages. These were assessed by the jury at £774 oa, from which £6 was deducted by the Court to cover wages tax on the eum of £120 claimed by and awarded to the plaintiff for loss'of wages. Mr. 0. C. Mazengarb appeared for the plaintiff, and Mr. C. A. L. Treadwell for the ".defendant. ■ . ■According to the statement of claim, at the time.of the accident the plaintiff was pillion riding on a motor-cycle along Willis Street when he was run into by a motorvan, owned by the defendant, but driven by Leslie Harrison, coming from Boulcott Street. • .- , , Mr. Mazengarb said that as a result or the accident the plaintiff's left leg was broken in - two places. In addition there was' some contusion, and damage was done to the tissue of the leg. The plaintiff wasl still receiving massage treatment, and he would be unable to- return to work for eome time. Evidence was given by the plaintiff as to' the condition of his leg, and by Sir Donald McGavin and Dr. Alexander Gillies. No evidence was called by the defence. Before hie Honour summed up, Mr Mazengarb and Mr. Treadwell addressed the jury. Mr. Treadwell criticised the amount of damages claimed by the defendant, describing it as exorbitant. '
