CUSTODY OF CHILD
CURIOUS CASE IN SYDNEY,
(Keceived October 19, 10 a.m.) SYDNEY, This Day. Litigation concerning the custody on the baby daughter of Mrs. Janet Mary," Tole, of New Zealand, had an abrupt! ending in "the Supreme Court before Mr. Justice Long-Innes. The child was brought here aboard the Wanganella on Tuesday by the mother, whoi is taking her to England by Saturday's liner. The father, now coming from, New Zealand, desired to prevent tha mother having custody of the child, and instructed a Sydney solicitor to apply; for a writ of habeas corpus^ During the proceedings an effort was made to compel the mother to enter the witness' box, but the Judge declined the applw cation. Mrs. Tole left the Court duri ing the argument with her solicitor. The Judge said that, he saw ito reason why she should not leave and no reason, why she- should be used to prove ,th» case for the other side. The Judge also gave a hint of legislation now before Parliament to alter cases such as this whereby a husband is sole custodian, at law.
The writ of habea» corpus was *•• fused.
