THE WRONG ACCUSED
GAMING CHARGE
(By Telegraph.) (Special to the "Evening Post.") AUCKLAND,'August 10. Tho inability o£ the prosecution to identify a person charged -with a gaming offence caused Mr. \V. R. McKoan, S.M., to dismiss a charge preferred against Charles Henry Wrathall in the Polico Court today. Tho count against the accused was that lie carried on the business of a bookmaker on July 10. A pica of not guilty was entered. Evidence was given by Constable Sylvester as to observations made of alleged betting in a hotel. Answering counsel, witness said that ho had been in the Force for three years and in Auckland i'or livo weeks. lie had not seen tho accused prior to July 10 or after July 14 until today. "Now look at the accused carefully, constable," stated counsel. "Is he the man you M\vl" Witness: No. Tho man who ,was pointed out to me aa Charles Henry Wrathall is a man shorter than the accused and he ,js fairer ,in .complexion. ' ' Detective-Sergeant O'Sullivan, who prosecuted, then said that in view of the evidence ho did not think there was any use in proceeding further with the ca&e. ''I think not," said the Magistrate, in discharging the accused.
