INJURIES TO MILLINER

Without proceeding to trial a claim for £700 general damages and £130 special damages, which was to have been heard in the Supreme Court, today, before- the Chief Justice (Sir Michael Myers) and a .jury, was settled for. a. sum of £-400, inclusive of special damages. The plaintiff was Annie Stephens, a milliner, and the defendants were Ke'mpthorne, Prossor, and Company's New . Zealand Drug Company, l>td., manufacturing chemists, and Frank William Mumme, a painter. : Tho claim was the outcome of an accident- fit the intersection of Majoi'ibanks Street and Courtcnay Place in which a motor-cycle ridden by Mumme and a motor-car owned by the defendant company were involved. Tho accident happened on February 19 of this year. Miss Stephens was a pillion passenger. on the motor-cycle. She was knocked (rft the machine, and was injured. In jjcr statement of claim she said she had been put to hospital and medical expenses, ■. and had lost wages which otherwise she would have earned. By consent, judgment' for tho plaintiff was .entered by tho Chief Justice against the first-named defendant for £400, together with witnesses' expenses and disbursements, and twenty guineas costs, and judgment for the ;<econd-named defendant, without costs against cither the plaintiff or the first defendant. His Honour also made an order for the remission of the jury fees, stating that the country had not been put to any expense. ' It pointed out by counsel for Ivomptborne, Prosser, and Company that the motor-car, although registered in tho company's name, was not being ilriven by any member or employee of the company at the time of tho accident.. ,The car had been placed in a garage for servicing, and was being driven by an employee of the garage. ■ Mr. O.C; Mazengarb appeared for the plaintiff; 3lr. \V.: E.
