SALE OF A BUSINESS
JEWELLERS AT LAW
Jewellers were th,e parties in an appeal case heard by the Court of Appeal yesterday afternoon and to-day. The appellant was George Langley, of Napier, and the. respondents were Delmonte and Patience, Ltd., diamond importers, of and A. Delmonte, company director. ■• The case concerned the sale of Mr. Langley's jewellery business in Napier in October, 1930. He agreed'to sell to Frederick William Jenkins, an employee, conditional upon his securing a guarantor. Jenkins had.not been long in possession of the business when the premises and stock were destroyed by fire following the earthquake in February, 1931, and,-he became involved in financial ruin. .
Mr. Langley's appeal was against a judgment given by Mr. Justice Ostler last April. In. the Supreme Court action, Langley sought to recover £480 claimed to be due to him either under a guarantee allegedly entered into by Delmbnte and Patience, Ltd., .or a breach of warranty of authority by A. Delmonte, managing director of the company. Mr. Justice Ostler gave judgment for the company on the first cause of action, and for A. Delmonte on the second cause of action, and it is against this decision that Langley appealed. Legal argument was unfinished' at the time of going to press. .*-
