COURT PROCEDURE
CHEAPER LITIGATION
LORD SANKEY'S SCHEME
CUTTING DOWN COSTS
United Press Association—By Electric Telegraph—Copyright. LONDON, 2nd May. In consequence of representations made by Chambers of Commerce and other organisations of business men, the Lord Chancellor, Lord Sankey, haa. drawn up new rules designed to reduce tho cost of litigation, and to simplify the hearing of law cases.
Certain classes of cases are definitely excluded from the new procedure, including libel, breach of promise, and cases where, the plaintiff alleges fraud, but a plaintiff in futuro will bo entitled to ask that other classes of cases be tried according to the simplified procedure.
Tho Judge will then be able to transfer the case to assizes or County Court, dispense with a jury, limit the number of expert witnesses, and. curtail tho number of documents placed before the Court, and all tilings now tending greatly to increase costs. The Judge will also te able to record the consent of both parties^ to waiving their right of appeal. • .
Lord Sankey's' memorandum points out that tho new pi-ovndure offers gTeat possibilities to suitors desirous, of a speedy conclusion of a case, but adds that no system can help those who are hostile to a settlement at a reasonable expenditure of time and money.
