'' - ;' ■ .'i ■' ■' ,' Appearing, on behalf,-of the defendant, Mr. F. W. Ongley said that the defendant had been driving a car practically every day for sixteen years, and during that time had had only one conviction againat him, for parking without a light. The defendant had had a companion in the car with him, and although they had both had. the same amount "of liquor, the other man was perfectly sober. The liquor the defendant had had affected him more on account of his being in a Weakened state as a result of influenza. When the defendant's1 companion realised that the defendant was not in a fit state to drive he steered the car into the kerb and it was there that the constable had overtaken it. Counsel suggested that iri view of the defendant's previous fine record his licence should not be suspended. "I must suspend his licence for a time," remarked the Magistrate when fining the defendant. l
