BARRISTER'S INJURIES

Evidence was completed in the 'Supreme Court to-day in the case heard by Mr. Justice Blair and a' jury, in which Sir Kenneth Douglas, barrister, of Wollington, claimed £34T 15s lid special and £2500 goncral damages from the Victoria Laundry Co., Ltd. The claim arose'out of an accident at tho junction of-Constable, and Kiddivford streets .on tho morning of 2Sth July, 1930., Sir Kenneth'was knocked down by a/ Victoria Laundry van, and suffered severe injuries and shock. Mr. W. E. Leicester, counsel for the defendant, ana Mr.'lL H. Cornish who, with Mr. H. J. V.' James, appeared for the plaintiff, addressed tho jury, after which h'"s Honour summed
up. The following issues were put to the' jury: (1) Was the van driver negligent in any of the respects alleged, and, if so, in what respect was he negligent? (2) Was the plaintiff negligent in any of the respects alleged by the defendant, and, if so, in what respect was ho negligent? * (3) Jf both tho van driver'and the plaintiff "were negligent,' could both of them up to the last moment have avoided the accident by the excicisc of reasonable care?
(4) If the answer-to the lust ibsue is in tho negative, then could either the van driver or tho plaintiff up to the last moment havo avoided tho accident by tho .exercise of reasonable care, and if so, which ono? In a fifth issue tho jury was asked to assess the damage to the plaintiff irrespecUvo of,the answers to the weicdiug issues. , ■ The jury had not retired when "The Tost" went to Press.
