HEAVY DAMAGES CLAIMED

Damages for.an accident, which occurred at the junction of Constable ana Eiddiford streets on the morning of 28th". July, 1930, were clamed by Sir Kenneth Douglas, baronet, of Wellington, against the Victoria Laundry Company Ltd, in the Supreme Court today, before Mr. Justice Blaii ana a Mr. H. H. Cornish;-with him Mr." H J. V. James, appeared for the plaintiff, and Mr. W.. E. • Leicester tor the defendant company. It was aUeged in the statement of claim that the accident was due to the negligent and unskilful driving of "William Albert Weldon, an employee of the company, whose . motor-van ran down the plaintiff, causing severe injuries and shock. The plaintiff was a patient m the Wellington Hospital from 28th July; to 12th August, and was then removed .to the Bowen street Hospital for further treatment, remaining there until 30th September. At a later period the plaintiff had to return .to the Wellington Hospital and was a patient there ±rom 21st February, 1931, to 3rd , °c-.^ As a result of the injuries the plaintiff was still receiving medical and nursing attention, and was advised that no would be permanently partially incapacitated. In addition to having Ms clothing damaged, the plaintiff had been unable to attend to his practice as a barrister and.solicitor, and had suffered and would continue to suffer substantial loss. A claim was made for £347 -Los lid special damages and £2500 general damages. The defence denied that Weldon had beeirnegligent hi any way, and pleaded that the plaintiff could, by the exercise ot reasonable and ordinary care havu avoided the accident. ' Medical witnesses called by Air Cornish stated that the plaintiff's left leg would be shorter than the right by one and a quarter inches. Gillies, orthopaedic surgeon at the Wellington Hospital, said that ho had been very anxious about the plaintiff's condition alter his admission to the-institution. . (Proceeding.)
