A PROVOKED ASSAULT
; An altercation between two men at a Public Works dance hall at Khandallah on 27th January had a sequel in the Magistrate's Court to-day, before Mr. T. B. M'Neil, S.M., when Allan Roland Thomas, a labourer, claimed £25 as damages from John Henry Dufty, tunncllcr, for alleged assault. Mr. C. J. o'Regan appeared for the plaintiff, and Mr. W. E. Leicester for the defendant. After hearing the evidence, his Worship said he was satisfied that the plaintiff had used insulting words to the defendant's daughter. "I am satisfied that the defendant got a great deal of provocation from the plaintiff, and liiat, to a certain extent, he was justified in taking the action he did," said the Magistrate. "There is no doubt that an assault was committed, and a man must not assault another. The sum of £25 for damages is ridiculous, as (he plaintiff was able to go to work It is a pity the, matter ever came to the Court at all, but I think the plaintiff is entitled to a little compensation." . Damages amounting to £1 were awarded.
