SECURITY OF DEBENTURES
Voluminous and invoked facts and, other material were presented to . the Court of Appeal on Thursday in the case stated between New Zealand Redwood Forests, Ltd., of Auckland, the appellants, and the New Zealand Insurance C 0.,, Ltd., respondents, which concerns a deed of covenant for securing debentures entered into between the parties. New. Zealand Redwood Forests, Ltd., the defendants in the Supreme Court action, are appealing from a judgment of Mr. Justice Smith on an originating summons under the Declaratory Judgments Act, 1908, and the Judicature Act, 1908. The Chief Justice (Sir Michael Myers) presided, andalso on the Bench were their Hpnonrs Mr. Justice Reed and Mr. Justice Ostler. Mr. A. H.'Johnstone appeared for New Zealand-. Eedwood Forests, Ltd., Mr. H. Bogerson for1 the New Zealand Insurance Co., Ltd., Mr. Eichmond lor Messrs. K. S. Cox and W. L. Wiseman, debenture-holders, Mr. C. E. Clarke for objecting debenture holders, and Mr. H. Meredith for Mr. H. T. Clements and other assenting debenture holders other than those represented by Messrs. Cox and Wiseman.
