A CYCLIST'S DEATH
MOTORIST FOUND NOT GUILTY
(By Telegraph—Press Association.) WANGANUI, 11th November. "Not guilty on both counts," vrai the verdict the jury returned after a retirement of three hours and a half, at the Wauganui Supremo Court today, before Mr. Justice Ostler, whea Cyril Augustus M'AlHster, taxi-driver, was charged that on 2nd August, 1930, at Wanganui, while intoxicated ia charge of a motor-car, he caused the death of Harold Grey town Rush, a.' cyclist. M'Allister was also charged with negligently driving the motorcar. The foreman of the jury asked if h» could read the statement, so that their finding would not be too brief, Tha statement was: — "On tho first charge, intoxication, the jury are agreed that the weight of evidence is not sufficient to prove that accused was intoxicated at the time of the accident, and therefore ha is entitled to the benefit of the doubt, and is therefore found not guilty. On the second charge the jury are agreed that tho weight of circumstantial "evidence is not sufficient to convict M'Allister of negligent driving, and he ii entitled to the benefit of the doubt and found not "guilty."
