THE RECOVERY OF RATES

NEW PLYMOUTH, This Day

Action was brought by the Crown against -the Inglcwood Borough Council to determine the principal question whether a local rating authority could exorcise its power of sale for recovery of overdue rates of land over which the Crown held a mortgage. The judgment of Mr. Justice Blair, who heard the case at the last sessions of the Supreme Court, goes in favour of the rating authority in holding that they have a right to exercise, powers of sale, and that overdue rates are a first charge, against Die proceeds. Mr. C. 11. Weston appeared for the Crown, and Mr. 1,. M. Moss for the Inglewood Borough.
