CARRYING COMPANY SUED
' Injuries received by Ivon Johnstono Hill, labourer, of Upper Hutt, in a collision early in the year on the Silverstream hill, between his motor-cycle ana a motor-lorry, formed the basis of his claim for £310 4s damages against the Cunningham Carrying Co., Ltd., heard in the Supreme Court to-day before Mr. Justice Blair and a jury. . Mr. P. J. O'Began appeared for the plaintiff, and Mr. E. Parry for the defendant. . .
It was alleged by Hill that when rounding a bend on the Silverstream hill on his motor-cycle on 31st January, a motor-lorry belonging' to and driven on behalf of the defendant company collided with him. His injuries included a fracture of the rightarin, as a result of which he was still totally disabled from working. The plaintiff alleged that the accident was due to negligence on the part of the driver of the lorry, as he gave no warning that the lorry was approaching, and that the lorry was travelling on the wrong side of the road. '
The statement of defence denied tha# the driver of the lorry was negligent, and alleged that the real cause of the accident was the negligent or unskilful manner iiv which the plaintiff ._ managed his motor-cycle. The defendant contended (a) that the plaintiff drovo at an excessive speed;(b) failed to lceop a sufficient look-out; (c) failed,to stop before striking the lorry or to swerve so a's to avoid it; (d) that tho plaintiff did not have adequate braking appliances on his motor-cycle. .
