DISPUTE OVER LAND DEAL

Legal argument was concluded yesterday afternoon before the Full Court in the case of Hubert Frederick Nunn, of Havelock North, against Robert M'Gowan, also of Havelock North. The action was for specific performance by M'Gowan of a contract to purchase a block of land from the plaintiff for £6000, and. the Court was asked to decide whether a fencing covenant, which was not disclosed before the agreement was entered into, was restrictive and constituted a sufficient ground for rescission of the contract by the defendant.
