LAND PURCHASE DISPUTE

The Full Court, consisting of their Honours the Chief Justice (Sir Michael Myers), Mr. Justice Herdman, Mr. Justice Blair, Mr. Justice Smith, and Mr. Justice Kennedy, to-day heard argument in connection with an action for specific performance in which- Hubert Frederick Nunn and Robert M'Gowan, both of Havelock North, farmers, were plaintiff and defendant respectively,

The defendant had purported to repudiate a contract for the purchase of land at Havelock North from the plaintiff on the ground of non-disclosure of a fencing covenant. The plaintiff* brought an action for specific performance in the Supreme Court at Napier, and this was' part heard by Mr. Justice MacGregor, and then removed to the Full Court for argument as to the effect of the fencing covenant on the transaction. '-

Mr. H. B. Lusk appeared for the plaintiff, and Mr. H. Holderness for the defendant.
