Bundle, S.M., found against Edgar Arnold Fox, who was proceeded against by the Audit Department on three informations of having acted as councillor on the- Oamaru Borough Council when disqualified from doing so. The defendant, a member of Gay's Oamaru fcstono Company, had offered to supply stone to tho Oamaru Beautifying Society to erect a wall in Sovern street, a work which was taken over by the Borough Council, and ultimately a contract was let to one Doehcrty, who used Gay's stone. The Magistrate hold that while it was not established that Docherfcy acted as a dummy for Fox, the latter was interested in the Eontract entered into by tho borough, and therefore disqualified. He had acted as a councillor later, taking part in a discussion on Docherty's contract^ and would bo fined £15 with costs. Security was fixed for appeal.
