DAIRY FARM PURCHASE
COURT OF APPEAL CASE
A case arising out of the purchase of a dairy farm, of about 80 acres, near Woodville, came before the Court of Appeal to-day. The facts were that Cissie Ellen Bottcher purchased the farm from Ellen Cammock, as a dairy farm. Not long after Mrs. Bottcher and her husband took possession, they became doubtful about tho quality of the farm, and ultimately took proceedings for rescission of the contract. In his judgment, Mr. Justice MacGregor said that on the whole of the evidence ho was satisfied that when the defondant sold the land as a dairy farm she well knew that it was not a "dairy farm" at all, owing to the presence of bone-sickness, and accordingly that it had no real carrying capacity as a dairy farm. His Honour rescinded the contract. Cammock appealed against tho decision on the ground that it was erroneous in fact, and in law. Mr. H. F. Johnston, with him, Mr. T. H. G. Lloyd, appeared for the appellant, and Mr. A. Ongley for tho respondent. (Proceeding.)
