■' An (notion: fbr£ 1275' damages, aris^ ing out of a motor collision on the Hutt road, engaged the attention of Mr. Justice Alpers and a jury in the Supreme Court to-day... The plaintiff was Donald M'lnnes Bell, a tiler, and the defendant was.CSarlepW. Mack, plumber. The plaintiff's claim was that when the.collision occurred near the Petone Railway Station between 11 ana 12 ■Slo!? o *..011** 116' night of 2na Ja^ary, 1926, the defendant's car was travelling at a dangerous speed, and was being driven on the . incorrect side of the road. / The plaintiff was accompanied by his wife and child. As a,result of the collision* Bell's thigh bone was broken, and for eight months he -was an inmate of the Wellington Hospital He further stated that he would suffer a permanent shortening of the leg and a stiffness of the knee, and would be debarred from carrying on his trade: He claimed.* 107, hospital and medical expenses; £365, loss of wages; *53, repairs to the motor-cycle;, and general damages, £750. •
, The defence was a.general denial to the allegations. Further, the defendant said that Bell caused his own injuries through his own negligence in carelessly driving:his cycle on the wrong side of the road. It was also claimed that if the plaintiff had exercised reasonable care and precaution, the collision could have been avoided. ' :
