UNPROFITABLE HOTEL.
Mother and sou wore at variance in the Magistrate's Court this week, when A. H. i'ishcuden, carpenter, of Wellington, claimed from Mrs. Catherine Dalley, also of Wellington, £45, allegedly due under the terms of a partnership in an hotel venture.
Air. S. Joll, for the plaintiff, said the parties entered into a verbal agreement to conduct an hotel in Picton, tho arrangement being thai, each should pay an equal share of the costs and each receive an equal share of the profits. Tho business did not prove a success, howevor, and the plaintiff, who had contributed £00 more towards the expenses than had his mother, was now claiming one-half of that amount. In asking for a nonsuit on the grounds that there was no evidence of a partnership having existed, and that, even if there had been a partnership,
there was no evidence of tho terms, Mr. J. Scott, who appealed for Mrs. Dallcy, said the understanding was that his client was merely to assist her £• d advise him. Fi.shenden was to stand the whole of the loss jhould there be any. Mr. E. Page, b.M., held that there had been a partnership, and gave judgment for the plaintiff for the full amount claimed, with costs.
