UNUSUAL .CIRCUMSTANCEg '; (By Telegraph.) - (Special to "The Evening Post.") ■ AUCKLAND, This Day. . An application for discharge from bankruptcy by Harry '.White Fr.etwell and Thoinay White Fretwellj farmers'of Te Kauwhata, came before Mi."Jus-: tice Hci^ian yesterday. ' The 'bankruptcy, aroso out of an assault,commit-! -ted upon Cluny James Drake, in August 1923 for which the brothers served'three years' imprisonment. They were also' in a. civil action for £638 damages. After this they wore declared insolvent. There has since been further litigation in connection with the conveyance of a property by H. W. Fretwell to his. brother. During the hearing of the original civil action it was alleged that the transfer was a scheme undertaken in anticipation of a .claim':,for... damages. Last December Mr. Justice Herdman refused to disallow, the transfer. •■ •As there is stijltho possibility, of an appeal against this judgment,, an.adjqumment of the present _ application was suggested. Counsel submitted that tho ■debtors had already suffered punishment for the assault. There was no reason why they should be further punished by the witholding of the discharge from bankruptcy. In view. of the possibility of an appeal,, his Honour adjourned the case, for two'months
