in ike Supremo Court to-day, his Honour Mr. Justice Ostler continued the hearing of an action brought by Joshua. Henry I'rosser, farmer. of Titahi Bay, against l-'rederick it. Ward, solicitor, as trustee (if Herbert John Uillett, late of Titahi Bay. The dispute was in respect to the purchase in 1019 of a block of land at Titahi Bay for £14,930. Certain payments were made, but the contract as to payment was not completed, and in March, 1U25, the vendor rescinded the contract, and required the purchaser to deliver up possession of the property. The purchaser did so. and claimed a reium! of the amounts "paid, .subject to any amount payable for deterioration to the property, etc. The vendor counter-claimed for the amounts in iin'car, plus such amount as was due for deterioration to the property. That amount was ascertained, by arbitration, as amounting to ;C2l(i; ami the vendor subsequently claimed a; 1000 as compensation for W sustained by the defendant by reason of the depreciation in the market value of the land. .Messrs. The Court was engaged to-day in hearing evidence as to value of the land, etc.
