COURT PROCEEDINGS CONTINUED.
The hearing was continued before Mr. CBv Oil- Walker, S.M.,'in the Magistrate's Court yesterday afternoon, of the case in which T. Eckford ajid Co., Ltd., of Blenheim, proceeded against the Wellington Local Federated Seamen's Union f*r the recovery of £100 by way of penalty for aii" alleged breach of- clause .48 of the New Zealand Seamen and Firemen's Award. .' i ' Plaintiff was represented by Mr. ;J. F. B. Stevenson and Mr. T. W. Young appeared for the defendant union. Three witnesses were called by counsel for the plaintiff, William M'Kihnon, master of 5 the Opawa, Clyno Stratham Gallic, a clerk in the employ of Eckford and Co., and William Edwin Fuller, of Levin and Co., who gave evidence! in support of the statements made in the j opening address.
The hearing will be further advanced on Thursday next.
Owing to a typographical error, part ! of the reply <£ counsel for the plaintiff to a preliminary point raised by the defence in the above case, was made to appear, in yesterday's "Post," as being portion of Mr. Young's statement on the question of the jurisdiction of the Court. Mr. Stevenson's reply should have read, "It was pointed out by Mr. Stevenson that the company was registered in November, 1924. and, the award was made in May, 1924. The position was that Mrs. Jane Eckford was originally the owner of the vessel, which was subsequently purchased by some of her children. They formed a limited liability company which was absolutely a new identity. "Mrs. Jane Eckford", as Mrs. •Jane Eckford, had absolutely no interest in the company. It would be idle to suggest that the company could, for instance, be sued for the'debts of" Mrs! Jane'Eckford."
