PETONE SITTING.
The monthly sitting of the Petone Magistrate's Court was held yesterday before Mr. C. K. Orr Walker, S.M. - Howard Bond, for being on licensed premises after hours, was fined £2 and 7s costs. In this case there was a strong conflict of evidence between Constable Scarry and two witnesses for the defence, and the Bench stated that \t believed the constable had told the exact truth concerning the matter. A. J. Kearns, for failing, to'send his child to school, was fined 5s and 7b costs Dugald Ferguson pleaded guilty to failing to.obtain a license for his motorlorry under the. heavy traffic • bylaw The fixing of the penalty was adjourned until January. Albert Barnes, for failing to blow the horn on his motor-lorry when approaching the intersection of a street, was fined 10s and 7s costs.
Judgment for plaintiffs by default was given in the following undefended civil cases : —"Hutt and Petone Chronicle" v G. M'Uvrido, £3 15s, costs £1 5 S 6d • C. H. Manning v. G. Bourke, £1 6s 6d' costs 8s ;J. S. Jackson y. C Chamlev' £9 17s 9d, costs £2 12s 6d; W. L. Jen' ness v. T. A. Odium, £4 6s 8d costs £1 6s 6d. '
In judgment summons cases, T. J Smith was ordored to pay -W.H. Payne £3 10s 5d on or before 10th January 1925, or suffer five days' imprisonment' and A. E. Hunt was ordered to pay j' C. Hammond £17 15s in. instalments oi £2 per month, or suffer fourteen days' imprisonment.
In a possession case, 1\ V. O'Neil] was ordered to give up possession of a tenement to C. It. Ounn, and also to pay the sum of 19s, vent due, witli tlin costs of the action. King (Mr. G. Findlay), the Magistrate, agreeing with Mr. Treadwell that the case bristled with more legal technical points than any other case he had ever had, made no order, and advised the plaintiffs that their only remedy lay in a Supreme Court action.
