PUBLIC NOTICE'is given'hereby that every mortgagor under a mortgage to which the above Act applies, who desires an extension of the term of his mortgage, must file in the Supreme Court H a Notice of Motion for an Extension J Order NOT LATER THAN THE 3l«t 0 JANUARY, 1925. The Act expressly 0 provides that;no extension can bo grant- tl ed unless the motion is filed before that o: date. ' ' .. " E The Notice must be filed in an office of the Supreme Court in the Provincial o District within which the mortgaged land n is situate. .• ■ n The Act does not apply to any mortgage to secure an account current, or to any mortgage executed after tho 24th October, 1919. Tho Act requires a mortgagor who ~ files a motion for an extension order to eorve without delay a copy of the notice of motion upon the mortgagee and also upon every person who is a "mortgagor"'of the same property. "Mortgagor" is defined to mean a person liable under the provisions of a mortgage, and to include any person who has guaranteed the .-, performance by tho mortgagor of any J covenant, condition, or agreement, expressed or implied in the mortgage, whe- ■> ther. such guarantee is expressed, in the mortgage or in any other instrument; and also to include any persqn against . whom a mortgagor has "a legal or equitable right of indemnity in respect'of any liabilities under the mortgage.
