LAND AGENT'S DOWNFALL
TWO MONTHS' IMPRISONMENT.
Drink was stated to be the cause of the downfall of a land agent named Frederick Joseph Fanning, 51, years of age, who appeared before Mr. E. Pago S.M. at the Magistrate's Court to-day on a charge of failing to comply with the terms of his probation. Accused -was admitted to probation for two years by the Supreme Court for fraudulently convorting irubt moneys to his owu use.
The Probation Officer, Mr. T. P. Mills, said that there was no special condition attached to thb accused's probation—as a matter of fact he only "got probation by the skin of his teeth." Drink seemed to be tho whole cause of the trouble and through his indulgence in liqour, Fanning had lost two good positions. He had considerable general ability and was an excellent salesman, but he had absolutely ignored repeated warnings to abstain from' drink. "I strongly recommend," concluded the officer, "that this man he sent to tho inobriate's island. It is the only place for him."
On behalf of the accused, Mr. H. F. O'Leary said that in his opinion, Farming's present plight was due to tho unfortunate omission on the part of tho Suprome Court to make it a definite- condition of his probation that he abstain from liquor and keep away from hotels. Really, ho was not before the Court for committing a broach of a particular con^ dition of his probation, but ho had failed to bo of good behaviour. Accused was an excellent salesman and it was well known that frequently when a deal was completed tho bargain was "clinched" with a drink. By this means, the accused had been led into hotels and had over-indulg-ed in liquor. Ho had not, however, como under the notice of the police as a drunkard and counsel mentioned that if given the chance, the accused intended leaving the town. , . Tho Magistrate felt that the accused had already had his chance. He had failed to heed the'repoatod warnings of Mr. Mills and would bo sentenced to imprisonment for two months.
