SALE OF A RESTAURANT.

S«P/emeCouit gave judgment for plaintiff tor £650, with costs, in the action by Mrs Mary Soverell against Miss Sarah Ash, on the ground of misrepresentation in a sale of the business of thG Alexander Restaurant in Queen street, for which plaintiff paid £800 cash and gave a mortgage for a similar amount for the balance of the, purchase money. Tho misrepresentation alleged was in respect of defendant's takings prior to the sale of the business. Mr. Justice Stringer said he acquitted tile defendant of any conscious and premeditated intention of cheating plaintiff. He thought the statement on • which plaintiff relied was made recklessly without reasonable grounds for believing it true, defendant, in anxiety to sell being careless of whether it was true or" not.
