The question whether a.. doctor is bound to speak in Court cropped up in the Supreme Court during the hearing of a divorce petition. Counsel for petitioner had subpoenaed Dr. Riley as to the respondent's condition when examined in hospital. When asked the result of the examination, witness said: "I am willing if the patient consents, but do not think I should divulge what passed without permission." Mr. Justice Sim said there was a distinction between communications between a doctor and a patient,, and the facts ascertained on examination. The privilege extended to anything the patient . communicated, but there was no privilege regarding the facts observed by the doctor on examination.
