His Honour Mr. Justice Hosking delivered judgment on Saturday in the case of an appeal of Cameron and Co., America, with branches in New Zealand' against the decision of Mr. Page,- S.M., in favour of Adess and Co., merciianle, of Dunedin, in a claim in the Magistrate's Court for £199 for goods sold and delivered.
The defendants had refused to UW delivery, and repudiated their contract on the grounds that the plaintiffs, befow delivering, had required defendants' t* vary the terms as to payment, insisting on. the- establishment of a letter of credit abroad instead of payment in New Zealand. The Magistrate gave judgment for the defendants. Plaintiffs appealed. The reserved judgment of Mr. Justica Hosking was that rescission of the contract wa* justified by the correspondence received by Adess and Co. The *ppeal was dismissed, with costs £10 10s. Mr. C. J.
