BREACH OF PROMISE TO
RE-MARRY.

(Received February 24; 1 p.m.) LONDON, 23rd February. •The Chief Justice is dealing with a unique Cdse, in which Sarah Bendix is suing Carl Bendix, stockbroker, London, for breach of promise to re-marry her. Bendix divorced his wife in 1920, on the ground of misconduct with his chauffeur. Counsel stated that Bendix afterwards re.-courted her, and proposed marriage. He lived with her, and told her she would get a .surprise oh her birthday. , He telephoned to her on that day, remarking : "This is my surprise : Will you marry me?" She consented, and' the wedding was arranged but postponed. Six days later Bendix married an actress. Mrs. Bendix gave evidence that after her divorce her husbdnd Settled fiilOO yearly on her.
