CLAIM FOR GOODS
LIABILITY DENIED.
Before his Honour Mr.. Justice Reed to-day, W. Booth and Co.-, timber merchants, Constable-street, Wellington, sued Donald M'Donald, Frederick Walter Ulyatt, and William M'Lean,- of 72, Rintoul-street, formerly carrying on the business of builders under the style of M'Donald, Ulyatt, and M'Lean, for the sum of £200 for goods alleged to have been delivered. Mr. C. A. L. Treadwell appeared for the plaintiffs. M'Donald and Ulyatt did not defend the action". M'Lean was represented by Mr. G. Toogood. The claim wa» for the balance o! an account for goods supplied up to September, 1920, totalling £150, and further goods delivered up to 23rd October, 1920, amounting to £74 6s. Of the total amount ,£24 6s Id was paid, leaving a balance'of £200.
The defence was that M'Lean had never been a member of the partnership firm.
