CONVICTED OF ASSAULT

After a trial lasting two full days, John Neil, a fireman formerly employed at the tramway power-house, was convicted last night oi 'assaulting one John Barrett, another employee at the powerhouse, so as to cause him actual bodily harm. The caae was heard befdl'e-his ! Honour Mr. Justice Hosking. The charge was divided into three counts : (1) That »with intent to ,do grievous bodily harm accused' did grievous bodily harm; (2) assault as to cause actual bodily harm; and (3) common assault. Mr. P. S. K. Macassey appeared for the Crown and Mr. C. A. L. Treadwell for the accused. The offence was. alleged to have been committed at the power-house, but accused denied having assaulted Barrett, and said h© was carrying out liis ordinary duties when he was alleged to have committed the offence. The jury retired at 4.30 p.m., and returned at 8.45 p.m. without a decision. His Honour asked them to retire again, and consider the point. The jury returned once more at 9.15 p.m., the foreman stating that they had agreed on. the second indictment (assaulting Barrett so as to cause him actual bodily harm), and found the prisoner guilty on that: count with the, very strongest recommendation to mercy. Tha jury was of opinion that there had been for some considerable time a good deal, of provocation. • ■ .* "Prisoner was remanded for sentence until Saturday morning.
