A LAND DEAL
■ Argument was heard by the Court of Appeal—the Acting-Chief Justice and their Honours Mr. Justice Stringer and Mr. Justice Salmond — this week regarding a land deal between Wharawhara Haimona, a Native, of Waharoa, and Robert Casey, butcher, also of Waharoa. The case, which concerned a contract for the sale of land outside Matamata, was argued before Mr. Justice Cooper, who decided that' Haimona must specifically perform the contract, and ordered that £167 damages must be paid in respect of the delay in completing the transaction. Haimona, whose defence was that he had entered into the contract by mistake, thinking that the purchase price was greater, appealed on the ground that the decision was erroneous in point of law and' in matter of fact.
, Mr. M. J. Hampson (Rotorua) ap peared for the appellant, and Mr. L. P. Leary for the respondent.
Judgment was, reserved.
