CLAIM FOR DAMAGES.

An incident in Wellington South some months ago whereby the bolting of horses attached to two vehicles caused a mishap to another horse and express, was Eubsequently made the subject of Court, proceedings, and in these finality was reached yesterday afternoon, when, at the Magistrate's Court, the. Magistrate (Mr. W. G. Rid dell, S.M.), delivered his reserved judgment. Robert A. Conuell, carrier (Mr. M. Luckie), claimed from Allan Orr, carrior^ and another (Mr. J. Scott) the sum of £62403 for the iosa of a horse and damage to an express, which, it \ra.i alleged, was due to the defendant driving a two-horse lorry with a broken or defective king-bolt. Plaintiff, on the day of the incident, had backed his horse and express against the kerb in Donald M'Loan-street, and whilst he was about to load a case.of goods, his horse bolted up the street along with another horse and cart belonging to one Culliford. Apparently the lattor's»horse had taken fright in Riddiford-street when defendant's horses and lorry galloped down with no one in charge. Culliford's horse, in bolting, collided with plaintiff's horse and vehicle, causing such injuries tbmfc the horse had to bo destroyed. The vehicle was also damaged. Having heard lengthy evidenced the Magistrate was of opinion that the nuts and cotter pin on the king-bolt were missing from defendant's lorry before tho occurrence, and that the defendant'! want of car© iv not making a more careful inspection of the vehicle before setting out in the morning was tho main cause of the accident to plaintiff's, hbrsa and express. Judgment was given for plaintiff for £50 (valuo of horse, £40; damages for injury to express, cartage, veterinary surgeon's fee, and low of work, £10), with costs £9 17s. '"
