One prisoner . was not brought up by the police, arid another who was at. large. • but not on bail, failed to appear. A third prisoner was missing, and Mr. Justice Herdmari sarcastically suggested that the registrar ' sliould .also call on Donald iVgh, who disappeared while on probationary. bail ; and..has not yet been arrested. His Honour said the prisoners sliould have been there, but apparently the CoOrt.lwas being.asked to.study their ..,.,. t ( ln another case, where counsel for the defence 'was riot.'present, his' Honour ordered the trial to proceed. Archie Atbol Jacobs, a riatjve of the Chatham Islands^ pleaded Vnilty to a charge of unlawfully carnally knowing a girl, also a,.native. Counsel for the prisoner said;prispner was engaged to the girl at the time of the offence, and was prepared to marry ;her... The girl was filling..; He asked 'that, prisoner should, be placed on probation, so' that application cbiild be made to the court for leave for the,'marriage of the couple. Mr. Jnstice Herdman said he proposed to take ah unusual Prisoner was liable to five years' imprisonment, but ' -in view-*of'.the circumstances he would be admitted to probation for.two years, and would have to pay £50, cost of the prosecution. .. . .
