SALE OF EGG PULP
Judgment was delivered yesterday afternoon by Mr. W. G. B-iddell, 5.M., ? in an action brought by the "Dominion Produce .Company, Ltd., against J. B. .'Andrew, pastrycook, Napier, to re- ■ cover £14 3s 4d lor the sale of five tins of egg pulp. The contract between the parties was made by a broker in Napier, and the eggs were to be placed on hoard ship at Wellington. The pulp was taken, out of the freezer, and placed on board the Ripple on 17th June. Some time after the arrival of the consignment at Napier the defendant's manager complained to the broker of the condition of the egg pulp, but no notice was given to the plaintiff until 26th June. The Magistrate's judgment was to the" effect that the eggs were in good order when placed on L'oard the ship, and that thereafter they were carried at the •purchaser's risk. Even if they were not in good condition on 'examination in Napier, any right the defendant might have had of l-ejecting them was lost through his failure to advise the plaintiff immediately. Judgment waa> given for the plaintiff for the amount of the claiti, with £5 11s costs. Mr. 0. C. Miwsngarb represented the company, and Mr. J. C. Morrison the defendant.
