"LAND ADJOINING"
Dudley Guilford Bayley, Harbour Board employee, proceeded against William Abernethy, of Day's Bay, at the Magistrate's Court yesterday, claiming refunds of certain sums paid as rent and expended on labour and material at a property rented by him at Patanga-cres-cent. Plaintiff, for whom Mr. N. A. Barker appeared, alleged that he was given to understand that he would have the use of some 19 acres of lajld adjoining the property, but later he had been preverited from using the land by a Mr. Stellin, the actual owner of the property. Ho therefore claimed a sum of £50, made up of excess over reasonable rent and the value of labour and material. The defendant, for whom Mr.'A. W. Blair appeared, ''admitted that he had mentioned that he had himself had the use of the land and had intimated that the plaintiff might also use it until such time as the owner might decide- otherwise, but, he 1 maintained, there had beo;.. .m> agreement regarding the 19 acres. He counter-claimed for a sum of ■'7 16s 8d as rent owing by the plaintiff. Mr. W. G. Riddell, R.M., non-suited the plaintiff on his claim, without costs, and gave judgment for the defendant on the counter-claim.
