Mr. Stout, S.M., this morning, on a technical point, dismissed the , case against the Millerton Miners' Union regarding an unlawful strike. The, Magistrate said the cause of action set out in. the statement of claim, and the one to which the defendant union was called upon to plead, was not the cause of action in' support of which the plaintiff appeared and called evidence, • nor was it the one for which a penalty of £20 is provided. .
