SEPARATED HUSBAND'S LIABILITY

Reserved judgment was given by Mr F. V. Frazer, S.M., o"ri Saturday an the case of the Wellington Hospital and Charitable Aid Board v. William M Robinson, a claim for £8 18s for medical treatment of defendant's wife. There was no dispute as to the correctness of the charges, the only question being one of law, as the defendant claimed that he was not responsible for the debt, as he. was separated from his wife, and was contributing to her support under a maintenance order. After reviewing the legal arguments, the Magistrate gave judgment for the plaintiff board, which had relied on the provisions of section 51 of the Destitute T?ersons Act, for the full amount claimed, with £1 18s costs, and added that the husband still had the right to apply to the Court to adjust the matter as between his wife and himself. During the hearing of the case Mr. W. F. Ward appeared for the plaintiff, and Mr. H. F. O'L'eary' for the defendant.
