'•:' NOTICE is hereby .given that at a Special Meeting of the Wellington City Council.r:held on the 26th day of August, 1918, the following resolution was passed:— \ .."■ "' ;, „ ■ . . ■ " The Wellington City Council, in pursuance and exercise of the powers vested in it by the 'Municipal Corporations Act, 1908,' and its Amendments, and all other powers enabling it in that behalf, doth hereby re-. solve, by way of Special Order, to accept a surrender of' Memoranda of Leasej Registered Numbers 3603 ,and 5604, of Lots 14 and 13, D.P. 540, from the Mayor, Councillors, and Citizens of tho City of Wellington, to Bendix Hallenstein, subject as to Lot 14 to Grants of Easements,-Regis-tered Numbers 33903 A,, 34595, and 35707; and to existing tenancies; and subject as to Lot 13 to Grant of Right of Way, Registered Number 3672, and to' existing tenancies; and to grant new leases to; the surrenderee of\ the said .lands, namely Jacob M'Eldowneyj of .Wellington, Warehouseman, for the unexpired portions of the terms of the surrendered leases, 1 one lease to fie of Lot 1 on the plan annexed hereto, subject to Grant of Right of. Way, Registered Number 3672 and Grants of .Party, Wall, Registered. Numbers. 33903 A and 34595, and to existing tenancies; the other to be of Lot 2 on tlio plan annexed hereto, subject to Grants of Party Wall, Registered Numbers 33903 A and .35707, and to . existing tenancies, at ■••: the annual rental of £126 for Lot 1, and at the annual rental of £77 15s for Lot 2, and upon the same terms and conditions as are fixed by the surrendered leases, with the following' variations:: — .. . ■ v "1.-There shall be no building covenant in.the new leases. . -, .■ . The lease of Lot 1 shall contain a covenant on the part of the Lessor that the Lessor shall not at any time erect, or; allow to be erected, on that portion of, Lot 2 coloured blue on the said plan any building or/ erection above, the ground level, and will ,not at any. ; time .without .the Lessee's : consent grant any lease of .Lot 2 that does not contain a, covenant on the part of the Lessee of Lot 2 not to erect npoiv the said part coloured blue, any building or erection above, the, ground level.- , ••■• „" ■ .■'■".■'' '■"'- . '■'■■ '.'■'' ' " And the Council further, resolves to accept from the surrenderer, at the time of the ■ carrying into effect of the foregoing Special Order, a transfer of the rights of the surrenderer under Transfers' Registered Numbers 33903 A, 34595, arid 35707, and to grant to the i Lessees under the new leases of Lot:! and Lot. 2, the benefits, rights,; and privileges under such grants of easement. The costs of the preparation of, and advertising of this: \Special Order, and the preparation and execution of the surrender and new leases, shall be borne by the said Jacob M'Eldowney."
