CLAIM FOR PLUMBING WORK

A claim for £40 Is lid for plumbing, painting, papering, and other renovating work done at the Kensington Hotel, was mado at the Magistrate's Court yesterday afternoon, before Mr. W. G. Riddell, S.M., by Charles W. Martin, plumber, of Wellington, for whom Mr. C. W. Neilson appeared, against Miss F. M'Donnell, of Wellington, and Mrs. Rebecca Love, of Petone. In January last, when the work was done, Miss M'Doimell was tenant of the ■ premises, and Mrs. Love was the owner. The defendants contended that plaintiff had performed certain of the work without direct instructions, and for this reason they submitted that he should be nonsuited. An item for papering was considered to have been included in another account. Regarding the charge for general plumbing, it was claimed that the tenant was not liable, it being- really a matter for the owner to settle. On behalf of the latter it was represented that no authority had. been given for the execution of the work for- which the charge was made. After his Worship had' heard evidence, judgment was entered for £18 7s 8d against the separate estate of Mrs. Love, with costs £3 Is; and regarding tho balance of the claim, his Worship found for defendant, Miss M'Donnell, with £1 Is coste. Mr. 0. Beere appeared for Mi's. Love, and Mr. G. G. Watson for James Campion, settler, of Fordell, attorney for Mies M'Donnell.
