CASE ON APPEAL
In the Supreme Court this afternoon, hie Honour Mr. Justice Hosking commenced the hearing of the case of Alfred Morris Taylor, gas inspector, Wellington, v. D. M'Gavin, plumber, Wellington, an appeal from a decision by Mr. D. G. A. Cooper, S.M. In the Lower Court, M'Gavin was charged with having improperly used gas, belonging to the Wellington Gas Company, Ltd., at 3, Broad-way-terrace, WeUingfcon. The defendant pleaoed not guilty, and the information was dismissed. The inspector appealed against that decision, on the ground that it was erroneous on a point of law. Mr. T. Neave appeared for the appellant, and Mr. P. \V. Jackson for respondent. The allegation against the defendant was made that he had disconnected the servico pipe leading into the metev and I fixed' it direct to the pipe leading to Ids house, whereby the gas, instead of passing through, the meter, was supplied direct to the house. There was no denial of the evidence, which the Magistrate held did not raise a prima facie case against the defendant. (Proceeding.)
