OASE OF HOLMES V. HOLMES. JUDICIAL SEPARATION. In the Supremo Court to-day, before the Chief Justice, Sir Robert Stout, Winnifred Mary Holmes petitioned for a judicial separation from her husband, Garnet Burn Holmes, motor garage proprietor, Wellington. Mr. A. Gray, .X.C.,' with him Mr. D. R. Hoggard, appeared for the petitioner, and the suit was undefended. Petitioner stated that she was married in St.. Mark's Church, Wellington, on 14th May, 1907. There was one child. A short time after Iheir marriage theparties went to London to live, and stayed there until January, 1911, when respondent left petitioner and went. to live with another woman, with whom he remained for two years. In the meantime, the woman's husband secured a divorce, respondent being joined as corespondent on that occasion. Petitioner did not divorce her husband, but returned to New Zealand with her child. Respondent left England for Sydney, from which place he wrote peaitent letters", and, as a result, petitioner rejoined him. However, respondent again left her, and petitioner returned to New Zealand. Respondent followed her to New Zealand, and persuaded her to live with him once more. Petitioner materi.ally assisted her husband in a moving picture business in the Dominion, after which respondent, became manager for Fullers' Pictures, At present ho was a garage proprietor, und Jia'd been keeping company with his typist. Following on the Island Bay scandal last year, he. was joined as a" co-respondent in the Divorce case of M'Ewen v. M'Ewen. Several witnesses gave detailed evidence regarding the respondent's behaviour .at 1 both Island Bay. and Karori. His Honour granted the separation, and gave the petitioner custody of the" child. He also agreed to make an order declaring the respondent unfit to have custody of the child at sny time. Respondent was. ordered to pay costs, wimesses's expenses, and disbursements.
