A NONSUIT
An action was heard in the Magistrate's Court before Mr. L. G. Reid, S.M., today, in which Bird and Jensen, billiardtable makers, proceeded against W. H. Edwards and Son, contractor, for the recovery of £25 for damage to cork linoleum on the floor of a billiard saloon in Manners-street. Plaintiffs' contention was that defendant constructed a down pipe to lead the water from the adjoining building to the drain, and tha-t during a heavy downpour of rain the drain was unable to carry the water away, and it overflowed' into the billiard _ saloon, causing damage. For the defence, it was submitted that the drain was large enough to carry the water from the right-of-way and roof, and plaintiff was nonsuited, with costs. Mr. P. Levi appeared for the plaintiff and Mr.' E. M. Beechey for the defendant.
