AN INSURANCE CONTRACT

. Judgment was delivered by the Court of Appeal to-da-y in the case of the New Zealand Insurance Company, Ltd. v. the Tyneside Proprietary, Ltd., coal mine proprietors. On the Bench at the hearing were their Honours the Chief Justice (Sir Robert Stout), Sir John. Dennistoh, Mr. Justice Cooper, arid Mr. Justice Chapman.

In the Supreme Court the insurance company claimed damages to the amount of £231 17s lid,. breach of warranty, and, in the- alternative, £231 17s lid for unpaid premiums'. Mr. Justice Sim gave judgment for the Tyneside Proprietary, and against that decision appeal was made.

The judgment of the' Court unanirrtously allowed the 1 appeal, and ordered judgment to be entered in the Supreme Court for - the insurance. company for the amount claimed,. with costs according' to scale. It was also ordered that respondents should pay the company's costs in the Court of Appeal on the middle seal© as from, a distance.
