LOWER HUTT COURT
After The Post went to press yesterday the following additional evidence was taken in the case brought by the Police against Richard Whyte, charged with assaulting R. C. Dick, Hutt County ranger. J
Frank George August gave evidence of taking charge of the horse returned by Dick, and of Whyte preceding Dick, who was on horseback, towards Whyte's tent. Whyte left about four ' minutes before Dick. He thought he heard a voice call hnn, and saw a riderless horse pass him. The Horse he afterwards knew was Dick's hol_e. He proceeded up the road and met Dick, who had blood on his clothes, and was being supported by . Mr. Brandon. The night was a dark one. He did not see anyone else except Whyte and Brandon go up the street.
Charles Brandon gave evidence of finding Dick, who was staggering down the road. The night was starlight, but hazy. He did not see Whyte. There might have been two hundred: persons hiding in the street and he would not have seen them. The place where the assault was alleged to have taken place was a dark spot. Dick was half dazed when he met him He had heard voices up the road just before the horse passed him. He knew accused, and did not consider he was likely to haveassaulted anyone.
This closed' the evidence for the prosecution.
Richard Whyte stated that after leaving Hobbs's house he spoke to August, and then went straight home. On the road to his tent,he saw a man standing near the alleged place of the assault. The statement of Dick that accused had spoken to Dick was untrue. He had no grudge against Dick. It was quite untrue that he had assaulted Dick. It was untrue that Dick had in November last impounded a horse of his. The signature "R. White" in the Tanger's book was not his. His name was Whyte He did not see Dick at all. The case was adjourned till this afternoon at 4 o'clock.
