LAND TRANSACTION

Hearing of the case of Bowron Bros, and Co., Ltd., Christchurch, v Thomas Morland, case on appeal, commenced before the Full Court of the Supreme Court yesterday afternoon. The Bench was occupied by his Honour the Chief Justice (Sir Robert Stout), Mr Justice Cooper, and Mr Justice Chapman. In June, 1914, Morland, as second mortgagee, sold to plaintiff a. property at Happy Valley, Wellington, for £35,000. The graduated land tax chargeable on the property at the 31st March, 1914, was £88 17s, which the defendant neglected and refused to pay, and it was paid by plaintiff in order to protect the property Plaintiff sued defendant for the amount, and Mr H W Bishop, the Christchurch Magistrate, before whoro the case was heard, held that the plaintiff was not entitled to recover, on the ground that the tax ought to have been paid by the owner of the land, K. Wallace. Against the Magistrate's decision Bowron Bros appealed. Mr. S. G. Raymond, K.C., with him Mr S. A. Atkinson, appeared for the appellant company, and Mr T. Young and Mr., M. J. Gresson for the respondent. The Court reserved its decision. ',
