COURT OF APPEAL
In the Court of Appeal yesterday after- ■ noon the hearing was commenced of the ', case of J. W. Souter and others v. A 3 L. Souter and others, an appeal against 1 ■a decision of Mr. Justice Cooper, de . livered at Auckland in an originating summons brought to determine certain ' ■ questions arising under the will of tiie \ late William Bums Souter, merchant, of Cambridge. The total value of th© i estate was over £6000, and the Court ; decided 1 that after making provision for '. trust funds of £1000 and £2000, A. L. '. Souter was to receive one-fourth share of the remainder of . the estate and also the i interest on* the sum of £1000 held on , trust. This decision was . appealed against by J. W. Souter and others. The Bench was occupied by their Honours the Chief Justice (Sir Robert Stout), Mr. Justice Denniston, Mr. Justice Edwards, and Mr. Justice Chapman. ]\lr. J. W. Macdonald, solicitor to the" Public Trust , Office, appeared for the Public Trustee, who represented by order of the Court the infant children of A. L: Souter ; Dr. Bamford, of Auckland, appeared for J. W. Souter and others; while Mr. J. R. Reed, K.C., of Auckland, with him Mr. J. L. Stout, appeared for A. L. Souter.
