COUNSEL'S IMPROPER REQUEST. SYDNEY, 24th June. The case of August Neilsen, claiming £150 damages against the Wharf Labourers' Union on the ground of preventing him obtaining employment as a wharf labourer, allegedly because he was German-bom, resulted in a. nonsuit. In the course of examination, counsel for the defence, seeking to show that the funds necessary to bring the action were subscribed by Germans, asked plaintiff if he waa a thorough Australian, and re-, ceiving an affirmative reply, added : "Then say. 'Down with the Kaiser.'" The Judge told Neilsen not to cay the words, because it was improper.
